The meeting opened at 10.02 am.

1. Subordinate legislation: The Committee considered the following negative instruments—

The Control of Pollution (Silage, Slurry and Agricultural Fuel Oil) (Scotland) Regulations 2003, (SSI 2003/531)

The Environmental Protection (Duty of Care) Amendment (Scotland) Regulations 2003, (SSI 2003/533)

The Air Quality Limit Values (Scotland) Amendment Regulations 2003, (SSI 2003/547).

The Committee agreed, being content with the instruments, to make no recommendation to the Parliament.

2. European issues: The Committee considered an update from the Convener on European issues. The Committee noted the issues contained in the paper and agreed to write to the Minister for Environment and Rural Development—

• seeking further information on:

- the Executive’s approach to a proposed new European regulatory framework for chemicals, and

- the Executive’s approach to implementation of the Waste Electrical and Electronic Equipment (WEEE) Directive and the proposed Batteries Directive.

• supporting the Executive’s view that the details of the Commission’s proposals relating to sheep identification are unworkable.

The Committee agreed to pursue during oral evidence sessions with the Minister in the new year a number of other issues related to fisheries, the implementation of CAP reform, and the proposals for the protection of animals during transport.

3. Nature Conservation (Scotland) Bill (in private): The Committee considered a draft Stage 1 report. A number of changes were proposed and agreed to. The Committee agreed to consider a further draft in private at its meeting on 10 December 2003.
