The meeting opened at 9.49 am.

1. Items in private: The Committee agreed to take item 6 in private, and also agreed to consider a draft report on the biomass inquiry in private at subsequent meetings.

2. Subordinate legislation: The Committee considered the following negative instruments—

the Solway Firth Regulated Fishery (Scotland) Order 2006, (SSI2006/57); and
the Inshore Fishing (Prohibition of Fishing for Cockles) (Scotland) Order 2006, (SSI2006/58).

The Committee agreed, being content with the instruments, to make no recommendation to the Parliament. The Committee also agreed to write to the Minister for Environment and Rural Development seeking further information on a number of points raised during discussion of SSI 2006/57.

3. Subordinate legislation: The Committee considered the following negative instrument—

the Foot-and-Mouth Disease (Slaughter and Vaccination) (Scotland) Regulations 2006, (SSI 2006/45)

and took evidence from Rhona Brankin MSP, Deputy Minister for Environment and Rural Development. The Committee agreed, being content with the instrument, to make no recommendation to the Parliament.

4. Animal Health and Welfare (Scotland) Bill: The Committee considered the Bill at Stage 2 (Day 1).

The following amendments were agreed to (without division): 15, 16, 18, 19, 20, 21, 22, 23, 24, 25, 26 and 27.

Amendment 13 was moved and, with the agreement of the Committee, withdrawn.

Sections 1, 2 and 3 were agreed to as amended.

The Committee ended consideration for the day, section 3 having been agreed to.

5. Subordinate legislation: The Committee considered the following affirmative instrument—

the draft Water Environment (Consequential and Savings Provisions) (Scotland) Order 2006.

Rhona Brankin MSP, Deputy Minister for Environment and Rural Development, moved motion S2M-4004 —

That the Environment and Rural Development Committee recommends that the draft Water Environment (Consequential and Savings Provisions) (Scotland) Order 2006 be approved.

After debate, the motion was agreed to.

6. Inquiry into developments in the biomass industry (in private): The Committee considered the evidence received to date for this inquiry and agreed to consider a draft report at its next meeting.

The meeting closed at 12:50 pm.
