The meeting opened at 11.32 am.

  1. Item in private: The Committee agreed to take item 5 in private.
  2. Subordinate legislation: The Committee considered the following affirmative instrument-

    the Farm Business Development (Scotland) Amendment Scheme 2004 (SSI 2004/236).

    Ross Finnie MSP, Minister for Environment and Rural Development, moved motion S2M-1402-That the Environment and Rural Development Committee recommends that the Farm Business Development (Scotland) Amendment Scheme 2004 (SSI 2004/236) be approved.

    The motion was agreed to.
  3. Subordinate legislation: The Committee considered the following proposed code-

    Scottish Outdoor Access Code: Proposed Code, (SE/2004/101).

    The Committee agreed to seek access to the submissions received by the Justice 1 Committee in response to its call for evidence on the proposed code, and agreed to defer consideration of the proposed code until its next meeting on 23 June.
  4. Subordinate legislation: The Committee considered the following negative instruments-

    the Plant Health (Export Certification) (Scotland) Order 2004, (SSI 2004/248);

    the Plant Health Fees (Scotland) Amendment Regulations 2004, (SSI 2004/249);

    the Seed Potatoes (Fees) (Scotland) Regulations 2004, (SSI 2004/250); and

    the Potatoes Originating in Poland (Notification) (Scotland) Order 2004, (SSI 2004/255).

    The Committee agreed, being content with the instruments, to make no recommendation to the Parliament.
  5. Water Services etc. (Scotland) Bill: The Committee considered arrangements for its consideration of the Bill at Stage 1 and agreed-


  6. the terms of a call for written evidence on the Bill;

    a timetable and programme of evidence, including proposed witnesses, for its Stage 1 consideration of the Bill;


  7. to delegate to the Convener authority to approve any claims under the witness expenses scheme arising from this programme of evidence.
