The meeting opened at 11.02 am.

1. Subordinate legislation: The Committee considered the following negative instruments-

the Shetland Islands Regulated Fishery (Scotland) Variation Order 2003, (SSI 2004/1)

the Ura Firth, Shetland Scallops Several Fishery Order 2004, (SSI 2004/5).

The Committee agreed, being content with the instruments, to make no recommendations to the Parliament.

2. Nature Conservation (Scotland) Bill: The Committee considered the Bill at Stage 2 (Day 2).

The following amendments were agreed to (without division): 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 139, 140, 141, 142, 38, 143, 39, 144, 40, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 133, 59, 60, 61, 123, 124, 125, 126, 127, 63, 64 and 65.

The following amendments were disagreed to by division-

115 (For 1, Against 7, Abstentions 0)

118 (For 1, Against 7, Abstentions 0)

119 (For 1, Against 7, Abstentions 0)

Amendments 41, 145, 149, 62, 134, 151 and 137 were moved and, with the agreement of the Committee, withdrawn.

The remaining amendments were not moved or pre-empted.

Sections 6, 8, 11, 18, 20, 24 and 25, schedule 2, and sections 26 and 28 were agreed to without amendment.

Sections 4, 5, 7, 9 and 10, schedule 1, and sections 12, 13, 14, 15, 16, 17, 19, 21, 22, 23 and 27 were agreed to as amended.

The Committee ended consideration of the Bill for the day, section 28 having been agreed to.

3. Item in private: The Committee agreed to consider its approach to the 2005-06 budget process in private at a future meeting.

The meeting closed at 12.48 pm.
