STIRLING-ALLOA-KINCARDINE RAILWAY AND LINKED IMPROVEMENTS BILL:
AMENDMENT AND EXPLANATORY MEMORANDUM

Since the Bill was introduced the promoter has established that there are subsisting private rights over the Balfour Street Level Crossing, Alloa. An amendment to the Bill is therefore being sought to authorise the formal closure of this private accommodation level crossing.

A copy of this amendment and the Explanatory Memorandum is provided below. In addition, copies of the amendment and the memorandum and an amended sheet 18 of the Parliamentary plans are available for inspection at the Parliament partner library in Alloa (Alloa library, 26/28 Drysdale Street, Alloa FK10 1JL).

Explanatory Memorandum

Amendment no. 17, when taken with section 9 of the Bill, provides for the closure of Balfour Street level crossing, Alloa. The Bill does not at present refer to this crossing in the list of private crossing closures because it had been thought that this was no longer a crossing of the railway to which rights of way attached. It having come to light that there are existing rights to use the crossing, it is necessary to amend the Bill so as to provide for the closure of a crossing that cannot be accommodated in the context of a modern railway.

Anyone wishing to object to the proposed amendment, has 21 days to do so. The objection period commenced on 2 April 2004 and ends at 5.00 pm on 22 April 2004. Objections must be lodged with the Private Bills Unit, The Scottish Parliament, Edinburgh, EH99 1SP (0131 348 6789, private.bills@scottish.parliament.uk). Any objection must be accompanied by the lodging fee of £20.00.
