Justice Committee
17th Meeting, 2010

The Committee will meet at 10.00 am in Committee Room 1

1. Declaration of interests: Dave Thompson MSP will be invited to declare any relevant interests.

2. Decision on taking business in private: The Committee will decide whether to take item 9 in private and whether its consideration of draft reports on the draft Advice and Assistance and Civil Legal Aid (Transfer of Tribunal Functions) (No. 2) (Scotland) Regulations 2010 and the draft Arbitration (Scotland) Act 2010 (Consequential Amendments) Order 2010 should be taken in private at future meetings.

3. Subordinate legislation: The Committee will take evidence on the draft Advice and Assistance and Civil Legal Aid (Transfer of Tribunal Functions) (No. 2) (Scotland) Regulations 2010 from—

Kenny MacAskill MSP, Cabinet Secretary for Justice;

James How, Head of Access to Justice Team, and Fraser Gough, Scottish Government Legal Directorate, Scottish Government.

4. Subordinate legislation: Kenny MacAskill MSP (Cabinet Secretary for Justice) to move S3M-6284—

That the Justice Committee recommends that the draft Advice and Assistance and Civil Legal Aid (Transfer of Tribunal Functions) (No. 2) (Scotland) Regulations 2010 be approved.

5. Subordinate legislation: The Committee will take evidence on the draft Arbitration (Scotland) Act 2010 (Consequential Amendments) Order 2010 from—

Kenny MacAskill MSP, Cabinet Secretary for Justice;

Hamish Goodall, Arbitration Bill Team Leader, and Graham Fisher, Scottish Government Legal Directorate, Scottish Government.

6. Subordinate legislation: Kenny MacAskill MSP (Cabinet Secretary for Justice) to move S3M-6285—

That the Justice Committee recommends that the draft Arbitration (Scotland) Act 2010 (Consequential Amendments) Order 2010 be approved.

7. Subordinate legislation: The Committee will consider the following negative instrument—

the Advice and Assistance and Civil Legal Aid (Transfer of Tribunal Functions) (No. 1) (Scotland) Regulations 2010 (SSI2010/166).

8. Annual report: The Committee will consider a draft annual report for the parliamentary year from 9 May 2009 to 8 May 2010.

9. Law Reform Working Group: The Committee will consider a letter from the Parliamentary Bureau on the outcome of its consideration of the Working Group’s report, on scrutiny of Scottish Law Commission Bills.
